In the recent Supreme Court decision of MacNamara v Auckland
Council & ORS the Court ruled in favour of the Council in
finding that they could not be held liable for accepting
certification from a private certifier, ABC certifiers, even though
the certifier's authority in relation to that type of house
construction had been revoked.
This decision will be a blow for many leaky home owners whose
homes were certified by private certifiers, most of whom are now
insolvent. For many of these owners, the Financial Assistance
Package may be an option for recovering a portion of their
losses. Please contact our leaky building team for more
information on the Financial Assistance Package.
