Recent Building Act changes have far reaching effects for developers and investors

Significant changes to the Building Act 2004 and new regulations came into effect on 1 January 2015. The legislation contains far-reaching changes for residential building contracts and some contracts of sale of residential properties by developers and investors.

Some of the changes specifically relate to residential building contracts for building work valued over $30,000. The Act requires that these contracts must be in writing, disclosure made and a written checklist provided. Fines may be imposed if requirements aren't met.

Provisions may also apply to agreements for the sale and purchase of newly built or renovated houses.
