The Ministry of Consumer Affairs has this week launched a review
of all consumer law. This will involve a review of the Consumer
Guarantees Act, the Sale of Goods Act, the Door to Door Sales Act
and another 7 or 8 similar statutes. The way in which all consumer
legislation interacts and works together is a key driver to this
review.
A discussion paper was issued this week and submissions close on
31 July 2010.
The purpose of the review is to see whether the consumer laws
which are currently spread over a number of statutes of varying
ages can be brought together into a single coherent scheme.
This will enable businesses and their customers to have a better
understanding of what each other expect and what the law expects of
them in their business dealings. In some cases it is likely
to provide long overdue updates to old law and may see the repeal
of some laws which are no longer of any practical effect.
